The protection provided to Arizona residents who use their emotional support animals (ESAs) is based on the Federal Fair Housing law, which is reinforced by the state’s own legislation that penalizes those who falsely assert that their pet is a trained service animal. Here is what the law requires of Arizona residents who need an ESA and what your landlord can and cannot do.

Federal update 2026. The Federal HUD clarified its enforcement of the Fair Housing Act regarding emotional support animals that were not trained on May 22, 2026. It is important to remember that Arizona’s own Fair Housing Act covers ESAs in housing and is independent of the federal FHA; therefore, your rights under the Arizona FHA will not be affected. Details of the enforcement may change, so it would be worthwhile to verify the current information with the Attorney General’s Civil Rights Division or an attorney.

Arizona ESA Laws – What You Need to Know

Arizona laws governing housing for ESA are based on two acts: the Fair Housing Act and the Arizona Fair Housing Act (ARS §41-1491 et seq.), which are implemented under the supervision of the Civil Rights Division of the Arizona Attorney General. Arizona has also adopted the act dealing with animal misrepresentation, yet it is important to understand the exact meaning of this legislation, as it is often misrepresented.

Overview of ESA Laws in Arizona

In Arizona, ESAs are not trained, but rather are sources of therapeutic comfort for people suffering from a specific mental condition, such as anxiety, depression, or PTSD. Arizona does not have an ESA housing regulation similar to the ones adopted by California or Utah, as ESA regulations are covered by federal and state fair housing laws.

Federal Fair Housing Act (FHA) Protections

In accordance with the FHA (42 U.S.C. §3601–3619) and HUD regulations, Arizona housing providers should:

  • Waive policies about no-pets, breed restrictions, and size restrictions for a recognized ESA
  • Does not require pet rent, pet deposit, or other fees for an authentic ESA
  • Offer this protection to most housing units, subject to some exceptions
  • Require documentation regarding the disability and animal necessity in cases where it is not clear

Arizona-Specific Law: ARS §11-1024

The Arizona statute on animal misrepresentation is ARS §11-1024, which is part of Arizona’s public accommodations law for service animals. Here are some crucial points about its reach:

  • What it includes: ARS §11-1024 prohibits false representation of an animal as a service animal (or service animal in training) to individuals or entities offering public accommodation – restaurants, stores, and other places
  • Fine: Civil fine of up to $250 for each violation
  • What it excludes: It covers public misrepresentation, but not housing documentation related to ESA. Arizona has no separate law that penalizes the mere possession of an ESA letter by tenants. Additionally, Arizona does not require a minimal period of the relationship between the provider and the patient before issuing an ESA letter.

Arizona is very clear that “emotional support, comfort, or companionship” is not considered a trained “task,” which is why ESAs don’t have public access protection.

Arizona Fair Housing Act

The Arizona Fair Housing Act (ARS §41-1491 et seq.) is similar to the FHA and makes it illegal to discriminate against people because of their disability in their housing. The Arizona Attorney General’s Civil Rights Division enforces the Arizona Fair Housing Act.

ESA Letter Requirements in Arizona

Though there aren’t ESA-specific statutory requirements imposed on Arizona landlords and their tenants as there might be in other states, here are the criteria your letter should have to be considered a valid one to be defended against the landlord:

  • Written by a licensed health care provider – a psychologist, psychiatrist, LCSW, LPC, LMFT
  • The result of a proper evaluation done by the provider, not a simple one-time test done in an online questionnaire
  • A confirmation that a recognized disability, which is listed under FHA, substantially limits at least one major activity in the tenant’s life
  • The description of how exactly the ESA helps the tenant due to the disability
  • The provider’s name, license number, license type, state where the license was obtained, date, and signature
  • Presented on professional letterhead

While it is not required by Arizona state law that the provider be licensed in Arizona, HUD guidelines, along with most landlords,s prefer there to be an actual therapeutic relationship underlying the letter, and not simply a certificate mill operation. Air Travel With ESAs From Arizona

According to the revised regulations of the DOT in January 2021 on the Air Carrier Access Act, airlines are not obligated to transport ESAs within their planes – only trained service animals will be allowed onboard. Some airlines traveling from Phoenix Sky Harbor Airport or Tucson International Airport have the option of allowing small ESAs onboard, based on their pet policy, with an extra charge.
