Tennessee Service Dog Laws: What Handlers Need to Know

Laws regarding service animals in Tennessee include several code types, and terminology is also somewhat unclear in terms of service animals in Tennessee, while the public accommodations law in Tennessee uses the term “dog guides,” not service animals. And complicating matters further is the fact that there have been significant changes to ESA laws in Tennessee in 2024.

How Tennessee Defines a Service Animal

Here starts the real complexity of Tennessee law. According to the “Public Accommodations” act (T.C.A. § 62-7-112), the law speaks of “dog guides” and ensures access to such people who are blind, deaf, hard of hearing, or physically disabled in any other way; yet, no definition of “service animal” is used in this law. As the experts stated, given the terminology of the state law, the psychiatric service dog cannot enjoy the explicit protection of access according to Tennessee law, although, at the same time, under ADA, it will be protected anyway.

The definition of “service animal” under Tennessee’s criminal code (T.C.A. § 39-14-216), however, seems to be much wider. Apart from the guide dogs, “service animal” also includes those dogs that are trained by a certified agency, as well as police, fire, and search-and-rescue dogs. Thus, the interference with the training dog would be treated equally with the similar actions regarding the fully-trained service animal.

Public Accommodation and Housing Rights

No person owning or working in a place of public accommodation, amusement, or recreation shall bar any blind, physically disabled, deaf, or hard-of-hearing individuals simply because they are accompanied by a dog guide. The same rule applies to dog guide trainers. Any violation of this provision is classified as a Class C misdemeanor. In a different regard, totally or partially blind individuals and other physically disabled individuals shall have the right to get access to housing accommodations without being discriminated against in renting an apartment due to their dog guides that come from certified training facilities; otherwise, this is classified as a Class C misdemeanor punishable by a maximum fine of $50.

Criminal Penalties for Harming or Interfering with a Service Animal

The deliberate harm caused to a service animal can be viewed as a crime according to many laws existing in the state of Tennessee. Unlawful and willful killing of a guide dog and causing permanent denial of services of the said dog to its owner can be viewed as a theft of the dog, where its value will be calculated considering the cost and the training of the dog. However, T.C.A. § 39-14-216 stipulates that the maiming, injuring, or attempting to injure a service animal, as well as causing harm to a service animal by one’s own animal, constitutes a Class A misdemeanor, whereas obstruction of a service animal when performing its tasks without inflicting harm constitutes a Class C misdemeanor. The most complicated case is the deliberate infliction of death or causing serious injury to a service animal without any justifiable reason, and it can be a class E felony.

Driving Near a Handler and Their Dog

In case drivers come across pedestrians using one or more guide dogs that have blaze orange collars or leashes, then it is their responsibility to stop their cars. In case the driver fails to do so, he commits a Class C misdemeanor.

Major 2024 Updates for Emotional Support Animals

This particular point is what is not covered in the previous version of this topic and is quite essential. First of all, Tennessee adopted Public Chapter 754 into the ESA housing laws of the state (T.C.A. § 66-7-111 and § 66-28-406). As per the new regulation, “reliable documentation” should not include letters from any websites that offer certificates or registration of ESA, and the providers must be able to provide authentic knowledge regarding a person’s disability – in other words, there should be an authentic relationship rather than a simple online form filling. Tennessee also changed its landlord liability provision and, consequently, the landlords would no longer be liable for any harm that might be inflicted upon their tenants through a support animal they accommodate under the terms of ESA laws. Finally, Tennessee ESA housing laws forbid collecting deposits, rents, and other payments for the support animal.

In addition to it, in 2024, Tennessee adopted a separate law (T.C.A. § 68-14-729) that forbids entering the indoor food service establishment with an emotional support animal; it does not concern trained service animals because they are protected by both state and federal laws in such situations.

Misrepresentation Penalties

A misrepresented animal is viewed as a class B misdemeanor in Tennessee, which could lead to a fine of up to $500 as well as community service. This is because Tennessee wants to protect actual handlers from this situation, since every time there is a misrepresented animal at a business, the credibility of the handler with his or her animal diminishes.

What Tennessee Law Doesn’t Require

All of these laws require any form of registration or certification before the recognition of the animal as a service animal. This comes down to the training of the dog, if it is a service animal, or the relationship between the person and the doctor in the case of an ESA letter.
